Notice of the Right of Any Affected Party to Request Removal of Certain Chapter 119 Information or Records

Any person has a right to request that a county recorder remove, from a publicly available Internet website, information made exempt from inspection or copying under s.119.071 or an image or copy of a public record, including an official record, if that image or copy is of a military discharge, death certificate, or a court file, record or paper relating to matters or cases governed by the Florida Rules of Family Law, the Florida Rules of Juvenile Procedure, or the Florida Probate Rules. However, grantor, grantee or party names may not be removed from the Official Records index. Requests must be notarized, state the statutory basis for removal, and confirm the individual’s eligibility for the exemption. To make a request contact the clerk’s office by mail or in person at Clerk of the Circuit Court & Comptroller, 205 North Dixie Hwy, Room 4.2500, West Palm Beach, FL 33401 or by email at COC_DM-PRIVACY@mypalmbeachclerk.com.

As of June 5, 2002, some Official Records documents may not be placed on a publicly available Internet website according to Florida Statute 28.2221. These documents are: Military Discharges, Death Certificates, Court Files, Records, or Papers related to matters or cases governed by the Florida Rules of Family Law, The Florida Rules of Juvenile Procedure, or The Florida Rules of Probate. Images of these documents are available for viewing inside our offices.

If your document is one of the above-listed documents and currently available on our Internet website, you may request that the Clerk of the Circuit Court & Comptroller remove the document image from view on our publicly available Internet website. This request must be in writing and may be delivered in person, by mail, electronically, or by facsimile. Please use the request form below and specify the book and page number of the document to be removed.

Florida law requires that images and copies of the above listed documents remain on file and available to the public upon request in the office of the Clerk of the Circuit Court & Comptroller.
